Terms of service

These terms are the agreement between you and First Pass. The short version: First Pass does the looking up and the laying out; you verify, you decide, and you send.

1. What First Pass is

First Pass is research assistance for licensed real estate agents. It looks up public records, lays out comparable sales, builds net sheets, reads documents you upload, and hands you documents to review and send.

It is not a survey, a title search, an appraisal, a broker price opinion, a comparative market analysis, a home inspection, a Loan Estimate, a settlement statement, or legal, tax, lending or insurance advice. It never states a value or a list price for a home.

2. Who may use it

You must hold an active real estate license, or work under the supervision of someone who does, and be at least 18. One account is for one person. Keep your password and any access keys to yourself; what is done with them is treated as done by you.

3. You verify, and you decide

Every fact is shown with its source and the date it was checked so that you can check it. Public records contain errors and change without notice; fees and tax rates change; a document read by AI can be misread. You are responsible for verifying anything you rely on or pass to a client, and for every professional judgment: pricing, what to ask for, what to disclose, and what to advise.

First Pass sends nothing to anyone. You review each document, and you send it.

5. What you upload

You keep ownership of what you upload and what you type. You give First Pass permission to store and process it in order to provide the service to you, and for nothing else.

You confirm that you have the right to upload it: that MLS material is from your own licensed access and for your own transaction, and that reports and contracts are from your own files. Do not upload blank copyrighted forms for storage or sharing.

6. Compensation figures

Any compensation figure on a net sheet is a starting point for arithmetic that you can change on every sheet. Compensation is always negotiable. It is not set by law, by any board or association, by the MLS, or by First Pass, and nothing in First Pass recommends or suggests a rate.

7. Vendors

Vendors are found for you to consider and pass along; your client chooses. A credential is shown as confirmed only when it was checked in the official directory named beside it, on the date shown. First Pass does not endorse or guarantee any vendor, and no vendor pays to appear.

8. Plans and payment

Your first property is free. After that, a property is $29, paid once, or membership is $89 a month for up to 15 new properties in a calendar month. Agents at the same office pay less per member as the office grows: $79 each once the office has 10 paying members, and $69 at 20. Every agent pays their own bill. Running the same property again is free. A property you delete still counts as used.

Payments are handled by Stripe, and your card details are held by Stripe, not by First Pass. A property paid for once stays on your account as a credit until you use it. Membership renews monthly until you cancel it from Settings, which stops the next charge; the current month runs to its end. A property that has been run is not refunded. When your office's rate changes, your price changes from your next bill, with nothing charged or refunded for the current month.

9. Coverage

First Pass covers Wake and Durham counties in North Carolina. An address elsewhere is turned away before anything is used. Sources outside our control can be slow or unavailable; when one does not answer, the document says so rather than leaving it out.

You can close your account at any time from Settings, which deletes your data as the privacy policy describes. We may suspend or close an account that breaks these terms or puts the service or other agents at risk, and will tell you why.

12. No warranty

First Pass is provided as it is. We work to make it accurate and available, but we do not promise that it is free of errors, that every source will answer, or that it is fit for a particular purpose. To the extent the law allows, all warranties not stated here are disclaimed.

13. Limit of liability

To the extent the law allows, First Pass is not liable for indirect or consequential losses, or for lost profits or lost commissions, arising from use of the service, and its total liability to you is limited to what you paid for the service in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited.

14. Governing law

These terms are governed by the law of the State of North Carolina, without regard to its rules on conflicts of law. Any dispute about them or about the service is to be brought in the state or federal courts located in North Carolina.

15. Changes

When these terms change, the date at the top changes, and a change that matters will be pointed out to you when you next sign in. Continuing to use First Pass after that means you accept the change.
